ITHACA, N.Y. -- The first murder trial ended without a verdict, and now the second time around, the jury in the Corbin Whyte murder trial is having a hard time coming to a unanimous decision.

Whyte is accused in the December 2010 shooting death of Paul Garcia. He is charged with two counts of murder, robbery and tampering with evidence.

Late Friday afternoon, the jury foreperson told the judge one person did not agree with the group. The judge told them to keep deliberating.

Just minutes later, the foreperson told the judge they had reached an impasse. The judge told them "not to violate their own conscience, but to consider the position of their fellow jurors."

Deliberations will resume Tuesday morning after the Martin Luther King holiday.
