OSWEGO COUNTY, N.Y. -- The Oswego County man convicted in the death of his 11-year-old step-sister is being transferred from state prison to the Oswego County Jail.

Alan Jones was convicted of second degree murder for killing Erin Maxwell in their Palermo home in 2008, but earlier this month, that charge was reduced to manslaughter and now Jones will be re-sentenced.

Jones' attorney argued that the evidence failed to show the depraved indifference required by the murder charge. The state appellate court agreed, saying that evidence presented at trial established that Jones called 911 and administered CPR at the time of the incident and was still on scene when authorities arrived.

Despite Jones' high profile, jail staff do not expect his return to cause any issues.

"He really was not a troublesome inmate. It doesn't appear he was in the state either. Certainly we will in transport and trial and everything we will keep a little closer eye on someone of a crime of this sorts, but I really don't foresee that being an issue," said Oswego County Sheriff Reuel Todd.

Jones now faces five to 15 years behind bars when he is resentenced. It is unclear when the resentencing will take place.
